www.embracehealthapp.com and the Embrace app (the "Platform") are owned and operated by Embrace Health Tracking Inc. References to the "Embrace app" or the "Embrace Health Tracking app" include the app currently published on the App Store as "Embrace: Family Health Tracker". Embrace Health Tracking Inc. is the data controller and can be contacted at: hello@embracehealthapp.com.
The purpose of this privacy policy (this "Privacy Policy") is to inform users of our Platform of the following:
This Privacy Policy applies in addition to the terms and conditions of our Platform.
Your health information belongs to you, not to us. Everything you enter in the Embrace app is stored on your device and synced to your own personal iCloud account using Apple's CloudKit service. We do not operate servers that store your health information, we cannot see it, and we never receive it. The app contains no analytics, no advertising, and no tracking. If you share a profile with a family member, that sharing happens through Apple's secure infrastructure, between your iCloud account and theirs, and we are never a party to the data.
For users in the European Union, we adhere to the Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016, known as the General Data Protection Regulation (the "GDPR"). For users in the United Kingdom, we adhere to the GDPR as enshrined in the Data Protection Act 2018.
We have not appointed a Data Protection Officer as we do not fall within the categories of controllers and processors required to appoint a Data Protection Officer under Article 37 of the GDPR.
By using our Platform users agree that they consent to the conditions set out in this Privacy Policy.
When the legal basis for us processing your personal data is that you have provided your consent to that processing, you may withdraw your consent at any time. If you withdraw your consent, it will not make processing which we completed before you withdrew your consent unlawful.
You can withdraw your consent by deleting your data within the app, deleting the application, and discontinuing your membership.

The Embrace app does not require an account, and we never receive the health information you enter in it. Payment for subscriptions is processed entirely by Apple; we never see your payment details.

The data we collect automatically on the website is used for statistics, improvements, and provision of service.
The data you enter in the app is used solely to provide the app's features to you, on your device and in your personal iCloud account.
We may disclose user data to any member of our organization who reasonably needs access to user data to achieve the purposes set out in this Privacy Policy. For clarity: this can only ever apply to data we actually hold (such as email correspondence), and never to the health information in your app, which we do not have access to.

Health information you enter in the app is stored on your device and in your personal iCloud account for as long as you choose to keep it. You control it entirely; we have no ability to retain or delete it. Data we hold directly (such as email correspondence) is stored only as long as necessary.
We do not operate any servers that store your health information, and we have no ability to view, access, or retrieve it. Health information you enter in the Embrace app is stored on your device and synced to your own personal iCloud account using Apple's CloudKit service, encrypted in transit and at rest. Your data belongs to your Apple ID, not to us.
If you use the family sharing feature, your data is shared only with the specific people you explicitly invite, through Apple's secure sharing infrastructure; we are never a party to that data.
While we take all reasonable precautions to ensure that user data is secure and that users are protected, there always remains some risk of harm. The Internet as a whole can be insecure at times and therefore we are unable to guarantee the security of user data beyond what is reasonably practical.
Website data we collect may be processed in Canada and the United States of America. Health information you enter in the app is stored in your personal iCloud account and handled by Apple under Apple's own security and privacy commitments.
When we transfer user personal data we will protect that data as described in this Privacy Policy and comply with applicable legal requirements for transferring personal data internationally.

The minimum age to use our Platform is 16 years of age. Parents and guardians may, however, record health information about their children within their own use of the app. We do not knowingly collect or use personal data submitted directly by children under 16 years of age.

You can view, modify, export, and delete your health information directly within the app at any time. Deleting profiles or records in the app deletes them from your device and your iCloud account.

The Embrace app does not use cookies.
Health information you enter is synced to your personal iCloud account. Deleting the Embrace app from your device does not delete the copy in your iCloud; reinstalling the app will restore your data. To permanently delete your information, delete the relevant profiles or records inside the app before removing it, or remove the app's data from your iCloud storage in your device settings. Because we never have access to your health information, we are unable to delete it on your behalf.
This Privacy Policy may be amended from time to time in order to maintain compliance with the law and to reflect any changes to our data collection process. When we amend this Privacy Policy we will update the "Effective Date" at the top of this Privacy Policy. We recommend that our users periodically review our Privacy Policy to ensure that they are notified of any updates.

This Children's Privacy Policy supplements the Platform's Privacy Policy and applies to the personal information of children in the United States who are under the age of thirteen (13) ("child" or "children"). This Children's Privacy Policy is made in accordance with the United States Children's Online Privacy Protection Act ("COPPA"). Any terms defined in COPPA have the same meaning when used in this Children's Privacy Policy.
Health and personal information about children may be entered by the member (typically the parent or guardian). This information is stored on the member's device and in the member's personal iCloud account; it is never transmitted to or stored by Embrace Health Tracking Inc.
The member enters the information (typically a parent or guardian).
The information is used solely to allow the member to record health information.
Children are not able to make their personal information publicly available on our Platform.
We do not disclose personal information about children to third parties. We never possess it; it remains in the member's own iCloud account, visible only to the member and to family members the member explicitly invites.
Third parties do not use our Platform to collect personal information about children who use our Platform.
A child's parent or guardian can review their child's personal information, delete it, and refuse any further collection or use of it at any time, directly within the app: open the app and delete the relevant records or profiles. Deleting records or profiles removes them from the device and from the member's iCloud account.
We will not require a child to disclose more information than is reasonably necessary to participate in an activity on our Platform.
